| (a) No person having
the control and custody of, or being the parent or guardian of, a minor
shall knowingly permit such minor to, nor shall such minor, be outside
the confines of his home site or congregate, wander, sit in an automobile,
loiter or play upon the streets, roads or other places of the village,
unsupervised or unenclosed lands, or other places of amusement or entertainment,
for the time hereinafter prohibited for the respective ages specified:
(1) Minors under sixteen
years of age, between the hours of 10:00 p.m. and 6:00 a.m. of the following
day.
(2) During the school
year, minors sixteen or seventeen years of age, between the hours of 11:00
p.m. and 6:00 a.m. of the following day on Sunday through Thursday, inclusive,
and between the hours of 12:01 a.m. and 6:00 a.m. of the following day
on Friday and Saturday.
(3) During the summer
vacation from school, minors sixteen, or seventeen years of age, between
the hours of 12:01 a.m. and 6:00 a.m. of the following day.
(b) This section shall
not apply to minors on an emergency errand or on legitimate business as
directed by the parent, guardian or custodian, nor minors who are employed
by an employer who has registered the employment of the minor with the
Police Department, nor to minors accompanied by a parent, guardian or custodian,
or some other person over twenty-one years of age who has been given responsibility
for such minor's control and custody by the person legally responsible
for the discipline of the minor.
(c) Any school, church,
lodge or other organization sponsoring functions wherein minors in attendance
will be out at a later hour than provided for in this section shall obtain
approval from the Chief of Police to have the minors remain until the time
when the entertainment will end. All minors attending such functions shall
be required to be within the confines of their respective home sites one-half
hour after such function is ended.
(d) Any person under
the age of eighteen years who violates the provisions of the above curfew
shall be apprehended and charged as being an unruly child and taken before
the Juvenile Court of Ashtabula County as provided in Ohio R.C. Chapter
2151.
(e) Any person having
control and custody of, or being the parent or guardian of, a minor who
has been convicted of or pleaded guilty to violating the provisions of
the above curfew twice within a twelve-month period is guilty of a misdemeanor
of the fourth degree. For each subsequent offense by the minor within a
twelve-month period, the person having control and custody of, or being
the parent or guardian of, the minor is guilty of a misdemeanor of the
third degree. |
